Trial and Appellate Court Victory in Alleged Theft of Technology Case
On November 14, 2017, the Fifth Circuit Court of Appeals affirmed a take nothing judgment (Judgment as a Matter of Law) awarded to FSC’s clients following a three-week jury trial in the United States District Court for the Northern District of Texas. The case involved common law misappropriation and fraud claims based on FSC’s clients’ alleged theft of thermal compression medical device technology. The plaintiff sought approximately $50 million in damages. Mike Cooke as lead counsel, along with co-counsel Olson & Cepuritis, handled the trial court proceedings and appeal.
