Private Equity Breach of Contract Victory

After more than two years of litigation in a private equity breach of contract row, FSC secured a ruling for its clients Insight Equity LP and Insight Equity Holdings LLC fully defeating all of the Plaintiff’s claims. The controversy involved the construction and interplay of multiple provisions of extremely complicated separation and partnership agreements and their impact on carried interests of a departing founder and partner in the private equity firm. The 352nd District Court in Tarrant County, Texas issued an Order declaring the parties’ rights and obligations which vitiated the Plaintiff’s multi-million dollar claims and confirmed FSC’s clients’ interpretation of the agreements in full. The Court’s final judgment also awarded FSC’s clients’ attorneys’ fees to be paid by the Plaintiff. Mike Cooke and Glenn Orman represented Insight Equity.
